शिक्षामित्र ऊषा ओझा की साठ वर्ष में सेवा समाप्ति पर रोक, मामला रिट याचिका के अंतिम निर्णय के अधीन
लखनऊ, 20 नवम्बर 2025। जनपद सुलतानपुर की शिक्षामित्र श्रीमती उषा ओझा द्वारा साठ वर्ष की आयु पूर्ण होने पर सेवा समाप्त किए जाने के विरुद्ध अधिवक्ता विजय कुमार पाण्डेय के माध्यम से दायर याचिका पर माननीय उच्च न्यायालय, इलाहाबाद, लखनऊ पीठ ने महत्वपूर्ण आदेश पारित किया है। माननीय न्यायमूर्ति श्री श्री प्रकाश सिंह ने निर्देश दिया है कि याचिनी के विरुद्ध किसी भी प्रकार की कार्रवाई रिट याचिका के अंतिम निर्णय के अधीन रहेगी।
श्रीमती उषा ओझा वर्ष 2006 से प्राथमिक विद्यालय विभारपुर, विकास खंड–जयसिंहपुर में शिक्षामित्र के रूप में कार्यरत हैं। उनकी सेवानिवृत्ति 23 नवंबर 2025 को प्रस्तावित थी, क्योंकि उसी दिन वे 60 वर्ष की आयु पूर्ण कर रही थीं। उन्होंने 17 फरवरी 2023 के उस शासनादेश को चुनौती दी है, जिसमें शिक्षामित्रों की सेवा समाप्ति आयु 60 वर्ष निर्धारित की गई है। उनका कहना है कि जब नियमित सहायक अध्यापकों की सेवानिवृत्ति आयु 62 वर्ष है और शिक्षामित्र भी समान कार्य व दायित्व निभाते हैं, तो 60 वर्ष की आयु में सेवा समाप्ति समानता के सिद्धांतों के विपरीत है। याचिका में इस संबंध में पूर्व के उच्च न्यायालयीन निर्णयों का भी उल्लेख किया गया है।
माननीय न्यायालय के आदेश का पालन करते हुए विद्यालय ने श्रीमती उषा ओझा को पुनः सेवा ग्रहण करा दी है और वे पूर्ववत शिक्षण कार्य में सक्रिय रूप से संलग्न हो गई हैं। कोर्ट के इस संरक्षण ने न केवल याचिनी को राहत दी है, बल्कि प्रदेश के हजारों शिक्षामित्रों में भी न्याय की नई आशा उत्पन्न की है।

Relief for Shiksha Mitra Usha Ojha: Termination at 60 Stayed, Matter Subject to Final Outcome of Writ Petition
Lucknow, November 20, 2025 — The Hon’ble High Court of Judicature at Allahabad, Lucknow Bench, has granted major relief to Shiksha Mitra Mrs. Usha Ojha of Sultanpur district, who had challenged the termination of her services upon attaining 60 years of age. The petition was filed through Advocate Vijay Kumar Pandey. Hon’ble Justice Shree Prakash Singh, while hearing the matter, directed that no adverse action shall be taken against the petitioner until the final disposal of the writ petition.
Mrs. Usha Ojha has been serving as a Shiksha Mitra since 2006 at Primary School Vibharpur, Block Jaisinghpur, Sultanpur. Her retirement was scheduled for November 23, 2025, the date on which she would complete 60 years of age. She had challenged the Government Order dated 17 February 2023, which mandates termination of Shiksha Mitras upon attaining 60 years. The petitioner argued that when regular Assistant Teachers retire at 62 and Shiksha Mitras perform similar duties and responsibilities, fixing a lower retirement age of 60 is discriminatory and violative of constitutional principles of equality. The writ petition also cites previous High Court judgments dealing with similar issues.
In compliance with the High Court’s interim order, the school authorities have reinstated Mrs. Usha Ojha, and she has resumed her duties, actively engaging once again in teaching and academic responsibilities. The court’s protection has not only provided immediate relief to the petitioner but has also revived hope for thousands of Shiksha Mitras across the state facing similar concerns.
